These Terms and Conditions (hereinafter referred to as "the Terms") set out the complete terms and conditions, rights and obligations of Glassflower Co., Ltd. (hereinafter referred to as "Glassflower"), operating the Book Your Ride brand and service, and you, regarding your booking and use of our services.

Book Your Ride is a brand operated by Glassflower Co., Ltd. References to "Book Your Ride", "we" or "us" throughout these Terms refer to Glassflower Co., Ltd. in its capacity as the operator of the Book Your Ride service.

It is important that you read and understand these Terms. If you do not agree to these Terms, you should discontinue your booking.

By entering into these Terms, you are willing to become a Customer of Book Your Ride and agree to provide all necessary information required and to comply with your rights and obligations as set out herein.

You hereby grant Book Your Ride the right to use your personal data as required, to process your payment details, to make all necessary announcements and communications to you, and any other requests in connection with your booking of our services.

DEFINITIONS AND INTERPRETATIONS

"Confidential Information" means full or partial knowledge, data or information relating to the activities or business of Book Your Ride, in tangible or intangible form, including but not limited to financial information, business plans, pricing, marketing strategies, client information, trade secrets, source and object codes, databases, and any other intellectual property or proprietary rights in whatever form of expression.

"the Website" means the Book Your Ride website and any related mobile applications.

"Services" means private transfer and transportation services provided by Book Your Ride or its partner Suppliers and Carriers.

"Affiliates" means any entity or person who directly or indirectly controls, or is controlled by, or is under common control with Glassflower Co., Ltd., including any brands, subsidiaries or associated entities operated by Glassflower, of which Book Your Ride is one.

"Business Day" means any day (other than Saturday, Sunday or public holidays) on which banks are open for general business.

"Carriers" means any legal entity or person who provides and renders transport services to customers pursuant to a contract of service.

"Customers" means any person or entity who books services through the Website under these Terms.

"Good Industry Practice" means the exercise of that degree of skill, diligence, prudence and foresight which would reasonably and ordinarily be expected from a skilled and experienced service provider acting in good faith.

"Personal data" means any information relating to an identified or identifiable natural person, as defined under applicable data protection regulations.

"Suppliers" means any legal entity or person who acts on behalf of any Carrier and provides Customers with information related to the relevant Services.

ELIGIBILITY. SUBJECT MATTER

By entering into these Terms, you acknowledge and guarantee full entitlement and authority to do so. Such consent is expressed by accepting these Terms within your booking process (by means of clicking "I accept Terms and Conditions" in the booking and payment window on the Website).

You shall not be entitled to use our services if you:

act in breach of these Terms;
make payments which are subject to a chargeback, fraud or reversal;
fail any identity or credit checks carried out by or on behalf of Book Your Ride;
are located in a territory from which Book Your Ride does not accept Customers;
are suspected of acting fraudulently or dishonestly.

You agree with all terms and conditions arising from these Terms and acknowledge not to enter into them if you do not conform to the above eligibility requirements.

YOUR RIGHTS AND OBLIGATIONS

By entering into these Terms, Book Your Ride grants you the right to book all available services on the Website.

By entering into these Terms you shall:

at all times comply with these Terms;
comply with all Supplier and Carrier policies, terms, procedures and regulations;
provide Book Your Ride with all required and accurate information in connection with your booking;
perform all bookings with due skill, care and diligence, in accordance with applicable laws and regulations;
not post on the Website any information that is defamatory, violent, unlawful, threatening, obscene or discriminatory;
not use the Website to make any speculative, false or fraudulent requests;
not seek to challenge the validity of Book Your Ride's intellectual property rights.

You hereby warrant and acknowledge that all information provided to Book Your Ride is correct, true, accurate, current and complete, and you will promptly notify Book Your Ride of any changes.

BOOK YOUR RIDE'S RIGHTS AND OBLIGATIONS

Book Your Ride shall solely determine methods of providing services and all relevant information available on the Website.

Book Your Ride shall have the full entitlement to use and monitor your personal data, payment details and any other details provided by you in connection with your booking, in order to process your booking, ensure compliance with these Terms, and monitor your usage of the Website.

Book Your Ride may deny access to the Website and/or to the booking of services at any time and for any reason, including but not limited to violation of these Terms.

Book Your Ride uses cookies which allow us to recognise your device when visiting the Website. If a cookie is used, the tracking time shall be at least thirty (30) days.

BOOKING AND PURCHASE OF SERVICES

You hereby guarantee that you have full entitlement to make bookings and payments on the Website.

While using the Website and making bookings you are solely responsible for the accuracy of the information you provide, your search requests, navigation through the Website, and understanding all information obtained in connection with your booking. Book Your Ride is not responsible for your activities in connection with it.

You acknowledge and understand that you are solely responsible for checking and complying with all applicable policies, terms, procedures and regulations in connection with your booking, including booking changes, modifications, cancellations and refunds.

Book Your Ride is fully entitled to apply service fees for bookings. Such fees are set in addition to fares provided by a certain Supplier and/or Carrier and are not subject to refund policies.

All payments are deemed to be inclusive of any applicable tax or bank commission. You are responsible for paying all costs and expenses incurred in connection with payments.

Booked and confirmed services may be changed or cancelled due to circumstances beyond Book Your Ride's control. In such cases, Book Your Ride shall undertake reasonable effort to notify you and provide assistance. Where applicable you may be subject to refund policies.

Book Your Ride in its complete discretion is entitled to modify, alter or withdraw your bookings and payment options at any time by giving notice to you.

PRIVACY POLICY

Book Your Ride believes in the protection of your privacy and processes your personal data in accordance with applicable data protection laws.

You grant Book Your Ride the right to use your personally identifiable information gathered under these Terms and to share it with Affiliates and business partners (agents, distributors, subcontractors and other affiliates) or other third parties, where applicable under relevant laws and regulations, to ensure the performance of services booked by you.

Book Your Ride collects and processes personal data such as your name, contact details, travel information and payment data solely for the purpose of providing the Services. Your data will not be sold to third parties unrelated to the provision of Services.

You have the right to request access to, correction of, or deletion of your personal data held by Book Your Ride, subject to applicable legal requirements. To exercise these rights, please contact us.

LICENCE. INTELLECTUAL PROPERTY RIGHTS. SECURITY

Book Your Ride grants you a non-exclusive, free-of-charge, worldwide right and licence to use the Website in order to obtain information in connection with your booking and to make such bookings.

You acknowledge that all intellectual property rights in the Website, software, source and object codes, and all related content shall remain with Book Your Ride at all times. You acquire only a limited right to use the Website under these Terms.

You shall not copy, translate, disassemble, decompile, re-sell, lease or create derivative works from any of Book Your Ride's intellectual property without prior written authorisation.

You shall immediately notify Book Your Ride if any claim is made or action brought for any infringement of Book Your Ride's intellectual property rights.

If you become aware of a breach or potential breach of security relating to the Website, you shall immediately notify Book Your Ride and use your best endeavours to prevent any actual breach.

CONFIDENTIALITY

You shall not use Confidential Information for any purpose other than in pursuance of your rights and obligations under these Terms, nor disclose it to any person without prior written consent of Book Your Ride.

Such obligations shall not apply to information that is publicly available, was already in your possession, or is independently developed by you without use of the Confidential Information.

Any unauthorised disclosure of Confidential Information shall entitle Book Your Ride to seek full reimbursement including but not limited to real and potential damages, consequential losses and legal costs.

FREEDOM OF ACTIONS. EXCEPTIONS

Nothing in these Terms shall constitute you and Book Your Ride as a partnership, association, joint venture or other co-operative entity.

You shall not assign, transfer or otherwise dispose of any of your rights and obligations under these Terms without prior written consent of Book Your Ride. Book Your Ride may assign its rights and obligations to any company from its group at any time.

LIABILITY. INDEMNITY. LIMITATIONS

You are liable to Book Your Ride for all obligations arising from these Terms.

Book Your Ride shall not accept any liability or demands whatsoever resulting from any change or cancellation of booked services, or the quality of services provided by a certain Supplier and/or Carrier.

BOOK YOUR RIDE HEREBY EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES WITH RESPECT TO THE SERVICES PROVIDED HEREUNDER, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS ONLY.

You shall indemnify and hold harmless Book Your Ride from and against any and all losses, demands, claims, damages, costs, expenses and liabilities suffered or incurred, directly or indirectly, by Book Your Ride in consequence of any breach by you of your obligations under these Terms.

The limitation of Book Your Ride's liability for any claim shall not exceed the total price of services booked by you within the last six (6) months prior to the date you became aware of a breach forming the subject of the claim. The time limit to commence proceedings shall be one (1) year from that date.

Neither you nor Book Your Ride shall be responsible for default of obligations caused by Force Majeure, including natural disasters, acts of war, state of emergency, strikes or acts of authorities.

NOTICES. COMMUNICATION

Book Your Ride shall send all notices and communications to you using the contact details you provided during booking.

You should send all notices and communications to Book Your Ride using the Contact page on the Website.

Notices will be deemed received four (4) hours after being sent, provided that if a notice would be deemed received outside the hours of 10:00 to 19:00 on a Business Day, it will be deemed received at 10:00 on the next Business Day.

MISCELLANEOUS

These Terms shall come into effect upon your acceptance within the booking process on the Website.

If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain enforceable to the fullest extent permitted by applicable law.

These Terms embody the entire agreement between you and Book Your Ride relating to the subject matter hereof. Book Your Ride is entitled at any time to amend or modify these Terms. The latest version is always available on the Website.

You shall not assign your rights and obligations under these Terms to any third party. Book Your Ride may assign its rights and obligations to any of its Affiliates.

These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall first be subject to amicable settlement within thirty (30) Business Days before being resolved through the appropriate courts. All proceedings shall be conducted in English.
